Terms of Service

Last updated: November 1, 2026

Welcome to INDIGENOUSLY. These Terms of Service explain the conditions that apply when you access our website or purchase products from our online store.

Please read these terms together with our Shipping Policy, Return & Refund Policy and Privacy Policy.

1. About INDIGENOUSLY

INDIGENOUSLY is an Indigenous-founded contemporary apparel brand based in Alberta, Canada.

Our online store is operated through Shopify and is available at https://indigenouslyco.shop.

For customer support, contact indigenouslyco@gmail.com.

2. Products and Descriptions

We make reasonable efforts to ensure that product descriptions, sizing information, photographs, specifications and pricing are accurate.

Actual colours may vary slightly depending on your device's display settings.

All products are subject to availability and production capacity. If we identify an error or cannot fulfil your order, we will contact you and provide an appropriate resolution, including a refund when required.

Nothing in these terms limits your remedies if a product is materially different from its description or fails to meet applicable legal standards.

3. Made-to-Order Production

Certain INDIGENOUSLY products, including our From the Rez to the World hoodies, are produced on demand through third-party manufacturing and fulfilment partners.

Production begins after an order is accepted for processing. Voluntary changes or cancellations may become unavailable once production has started, subject to applicable consumer cancellation rights.

4. Pricing and Payment

Prices are displayed in Canadian dollars unless otherwise indicated.

Applicable shipping charges, taxes and other amounts collected by the store will be presented during checkout before payment is submitted.

Payment must be successfully authorized through an accepted payment method.

We do not guarantee that a product will remain available at a particular price indefinitely. Price changes do not retroactively change the agreed price of an accepted order.

5. Order Confirmation

After placing an order, you should receive an order confirmation at the email address provided during checkout.

Please retain your confirmation for your records and review it for accuracy.

If you notice an issue with the products, quantities or delivery information, contact us promptly.

6. Shipping and Delivery

Delivery availability, rates, processing estimates and tracking information are described in our Shipping Policy.

Production and transit estimates are not guarantees unless we expressly agree otherwise.

If an order cannot be shipped within the applicable timeframe, we will communicate the delay and offer cancellation or refund options where required by law.

7. Returns, Refunds and Cancellations

Our Return & Refund Policy explains our made-to-order return restrictions, defect reporting, approved returns, refunds and cancellation procedures.

That policy operates alongside, and does not replace, applicable consumer protection rights.

8. Intellectual Property

The INDIGENOUSLY brand name, original graphics, artwork, designs, photographs and website content are owned by INDIGENOUSLY or used with the appropriate rights or permissions, except where otherwise indicated.

You may not reproduce, distribute or commercially exploit these materials without authorization, except where permitted by applicable law.

9. Acceptable Website Use

You agree not to use the website for unlawful or fraudulent activities, interfere with its operation or security, attempt unauthorized access, or misuse the services provided.

We may take proportionate steps to protect the website, customers and our business against misuse.

10. Third-Party Services

Our website uses Shopify and may use third-party services for payment processing, manufacturing, shipping, analytics and other business functions.

Third-party services may have their own terms and privacy notices.

INDIGENOUSLY remains responsible for its obligations to customers under applicable law and these terms. The use of a third-party supplier does not eliminate those obligations.

11. Privacy

Your personal information is collected, used and disclosed as described in our Privacy Policy.

12. Website Availability

We make reasonable efforts to maintain the reliability, security and availability of our online store.

Temporary maintenance, technical issues or circumstances outside our control may affect access.

Nothing in these terms excludes liability or remedies that cannot lawfully be excluded.

13. Changes to These Terms

We may update these Terms of Service to reflect changes in our services, business practices or legal obligations.

The current version will be available on our website with its effective date.

Changes will not retroactively remove rights arising from previously accepted orders.

14. Governing Law

These terms are governed by the applicable laws of Alberta and Canada, subject to mandatory consumer protections and jurisdictional rights that apply to customers elsewhere.

Nothing in these terms requires customers to waive legal rights, legal warranties or access to courts where such a waiver is prohibited by law.
